22. |
The Cardholder shall not use or attempt to use the Card(s) for any transaction which is not authorized by EON Bank. Where EON Bank has given prior authorization to the Cardholder to use the Card(s) in any authorized transactions, the Cardholder shall not use or attempt to use the Card(s) to facilitate such transactions unless there are sufficient funds in the Cardholder’s MasterCard Unembossed or Visa Prepaid Card Account to meet the transaction to be carried out. |

The Cardholder shall pay to EON Bank the first year’s Annual Fee together with the Joining Fee (if applicable) and the Initial Top-Up Payment. Unless otherwise waived, the Annual Fee shall be paid annually in advance. The Cardholder hereby irrevocably and unconditionally authorizes EON Bank to debit the Cardholder’s MasterCard Unembossed or Visa Prepaid Card Account with the full amount of such Annual Fees which shall be non-refundable. |

All purchases made by the Cardholder outside Malaysia shall be converted into United States Dollars and then converted into Ringgit Malaysia at the then prevailing exchange rate as determined by MasterCard International Inc., and EON Bank may impose a service charge of Two per centum (2.00%) or such other rate as may be determined by EON Bank from time to time, and EON Bank is irrevocably authorised by the Cardholder to debit such service charge from the Cardholder’s MasterCard Unembossed or Visa Prepaid Card Account on the converted amount of such purchases. |

The amount of the Prepayment in the Cardholder’s MasterCard Unembossed or Visa Prepaid Card Account shall automatically be reduced by the value of any cash withdrawal or the purchases including the service charge or whatsoever fee (if relevant) payable each and every time the Cardholder makes a withdrawal at the ATM or purchases goods and/or services at the Merchants or via online purchases by use of the Card(s) and the current available balance of the Prepayments shall be determined by deducting the aggregate of the total value of the purchases or withdrawal made with the Card(s) and all fees and charges payable pursuant to the Card(s) from the total value of the Prepayments made from the time the Card(s) is issued. |

Unless otherwise provided herein, the Cardholder shall in all circumstances accept full responsibility for all transactions processed by the use of the Card(s), whether or not processed with the Cardholder’s knowledge, acquiescence or authority. Notwithstanding Clause 18 above, EON Bank shall not be liable if any intended purchase transactions of the Cardholder through the production of the Card(s) by the Cardholder at any Merchant or where applicable, through online purchases at any time are not successfully conducted for any reasons whatsoever. |

EON Bank shall not be responsible for any goods and/or services purchased or received through the production of the Card(s) by the Cardholder or where applicable, through online purchases and supplied by the Merchants and makes no warranty whether express or implied by operation or law or otherwise as to the merchantability, fitness for purpose or otherwise of any goods which is supplied by the Merchants. |

The Card(s) is not transferable and EON Bank shall not, in any circumstances be liable for any unauthorized or unlawful purchase transaction or withdrawal of cash through the use or production of the Card(s) by any unauthorized person. EON Bank is not under any obligation to verify the identity or the authority of any person using the Card(s) purportedly in the Cardholder’s name and EON Bank shall not be liable for acting in good faith for honoring the purchase transaction or withdrawal of cash which are performed by the authorized or unauthorized person through the use or production of the Card(s), regardless of the circumstances prevailing at the time when such purchase transaction or cash withdrawal is being carried out. All purchase transactions or cash withdrawals shall be deemed by EON Bank to have been made by the Cardholder and the Cardholder shall be liable for all charges whatsoever and howsoever arising from these purchase transactions or cash withdrawals. |

The Merchant who provides the goods and/or services shall also not be held liable for the unauthorized or unlawful purchase transaction through the use or production of the Card(s) and shall be entitled to deal with the holder of the Card(s) and shall be under no obligation to verify the identity of the holder PROVIDED THAT the Merchant shall not honor the Card(s) if the Merchant has been notified by EON Bank not to honor such Card(s). |

The Cardholder shall use reasonable precautions to prevent loss, theft, misuse of the Card(s) or disclosure of the PIN to an unauthorized person and shall immediately notify EON Bank in writing to be addressed to EON Bank Berhad, Card Centre, 13th Floor, Menara EON Bank, 288, Jalan Raja Laut, 50350 Kuala Lumpur or via telephone at 03-2616 1133 or facsimile at 03-2697 4388 of the loss or theft or any misuse of the Card(s) or the disclosure of the PIN to any unauthorized person. The Cardholder shall be responsible and be liable in all circumstances for all transactions processed by the use and misuse of the Card(s) prior to receipt by EON Bank of the written notification, whether or not such transaction have been processed with the Cardholder’s knowledge, acquiescence or authority. |

Notwithstanding prompt notification by the Cardholder, EON Bank shall be allowed forty-eight (48) hours from the time of receipt of the notification to de-activate the Card(s) and the Cardholder shall remain fully liable for all transactions occurring or incurred during this forty-eight (48) hour period. |

EON Bank shall not bear any responsibility and be held liable, in the event of any loss or theft or misuse of the Card(s), for honoring any purchase transactions or cash withdrawals occurring or incurred prior to receiving the notification from the Cardholder and within the aforesaid forty-eight (48) hour period. |

When a lost or stolen Card(s) is found, the Cardholder shall not use the lost Card(s) retrieved but shall cut it into two (2) and shall return the same to EON Bank immediately upon retrieval of the Card(s). EON Bank will be under no obligation to issue a replacement Card(s) to the Cardholder following its loss or theft. Any replacement Card(s) will be subject to a card replacement fee of Ringgit Malaysia Fifteen (RM15.00) or such other rate as EON Bank may prescribe at its absolute discretion. |

Upon receipt of the notification from the Cardholder of such loss or theft or misuse of the Card(s), EON Bank shall refund to the Cardholder the Prepayment or any part of it unused or remaining thereof in the Cardholder’s MasterCard Unembossed or Visa Prepaid Card Account less all monies due from the Cardholder to EON Bank under the terms of this Agreement and EON Bank shall not be liable to pay any interest on the Prepayment or the amount remaining in the Cardholder’s MasterCard Unembossed or Visa Prepaid Card Account to the Cardholder. |
35. |
All successful refunds under Clause 34 shall be credited to the Cardholder’s new MasterCard Unembossed or Visa Prepaid Card Account and no cash refunds will be allowed. |
